3. Orders & Contract Formation
The information provided on the Website (including product descriptions, prices, and availability) constitutes an invitation to treat, not a binding offer. When you place an order through the Website, you are making a binding offer to purchase the selected products in accordance with these Terms.
We will send you an email acknowledging receipt of your order ("Order Confirmation"), but this does not constitute acceptance of your offer. A binding contract between you and JoyCan ("Contract") will only be formed when we send you a shipping confirmation email ("Shipping Confirmation"), which indicates that we have accepted your order and will dispatch the products.
We reserve the right to refuse or cancel any order at our sole discretion, including but not limited to cases where: (a) product information is incorrect or inaccurate; (b) products are out of stock; (c) we have reasonable grounds to suspect fraudulent activity; or (d) you fail to comply with these Terms. If we cancel an order after payment has been received, we will issue a full refund to your original payment method.
4. Custom Products & Cancellation Rights
All JoyCan products are custom-made to your specifications (including size, design, and embellishments). Due to the personalized nature of our products, you acknowledge that you have no statutory right to cancel your order once it has been confirmed (i.e., no "cooling-off period"), except in cases where the product is defective or does not conform to the agreed specifications.
If you wish to modify or cancel your order, you must contact our customer service team within 24 hours of placing the order. We will use reasonable efforts to accommodate your request, but we cannot guarantee modification or cancellation if production has already begun.
5. Intellectual Property
All intellectual property rights in the Website (including text, graphics, logos, images, software, and product designs) and all JoyCan products (including custom designs created for you) are owned by or licensed to JoyCan. You may not reproduce, distribute, modify, or use any of these intellectual property rights without our prior written permission.
Custom designs created for you are for your personal, non-commercial use only. You may not resell, reproduce, or distribute custom designs or products without our explicit written consent.
6. Product Liability & Warranties
We warrant that our products will be free from material defects in craftsmanship and materials for a period of 30 days from the date of delivery ("Warranty Period"). This warranty does not cover: (a) normal wear and tear; (b) damage caused by improper use, care, or storage; (c) modifications made to the product by you or a third party; or (d) damage resulting from accidents or external factors.
If you believe a product is defective within the Warranty Period, please contact our customer service team with details of the defect and proof of purchase. We will assess the claim and, at our sole discretion, either repair the product, replace it, or issue a refund.
JoyCan shall not be liable for any indirect, consequential, or incidental damages arising from the use of our products, including but not limited to damages related to competition performance or missed events.
7. Limitation of Liability
To the maximum extent permitted by applicable law, JoyCan's total liability to you in connection with the Website, Services, or any Contract shall be limited to the total amount paid by you for the relevant products. We shall not be liable for any loss of profits, revenue, data, or other indirect or consequential losses, whether arising from breach of contract, negligence, or otherwise.
Nothing in these Terms shall exclude or limit our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) any other liability that cannot be excluded by applicable law.
